OWEN’S LANDSCAPING TERMS OF SERVICE

Welcome to Owen’s Landscaping (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, services, and any related communications.

By requesting a quote, booking a service, or using our website, you agree to these Terms.

1. SERVICES PROVIDED

Owen’s Landscaping provides residential and commercial landscaping services, including but not limited to:

  • Lawn mowing and maintenance
  • Seasonal cleanups
  • Landscaping design and installation
  • Property maintenance services

All services are subject to availability, weather conditions, and operational capacity.

2. ESTIMATES & APPROVAL

  • All quotes are estimates, not final invoices
  • Pricing may vary based on property conditions, materials, or scope changes
  • Work begins only after customer approval

For large projects, a deposit may be required before scheduling.

3. SCHEDULING & ACCESS

Customers agree to:

  • Provide accurate service address and contact information
  • Ensure access to the property on the scheduled date
  • Secure pets and remove obstacles

Failure to provide access may result in rescheduling or cancellation fees.

4. CANCELLATIONS & RESCHEDULING

  • 24+ hours notice → no fee
  • Less than 24 hours → up to 25% cancellation fee
  • Large or material-based jobs → 48 hours notice required

Missed appointments due to lack of access may be treated as late cancellations.

5. PAYMENTS

We accept:

  • Credit/debit cards
  • Checks
  • ACH/bank transfer
  • Digital payments via our platform

Payment terms:

  • Due upon completion unless otherwise stated
  • Late payments may result in service delays or account restrictions

6. REFUNDS & SERVICE GUARANTEE

  • Completed services are non-refundable
  • If service quality does not meet standards, we will correct the issue at no charge

Design fees and deposits are non-refundable once work begins.

7. WEATHER & DELAYS

Services may be delayed due to:

  • Rain
  • Snow
  • Extreme heat
  • Unsafe conditions

Delayed services will be rescheduled at the next available time.

8. PROPERTY CONDITIONS & LIABILITY

Customers are responsible for:

  • Marking underground utilities or hazards
  • Removing valuable or fragile items
  • Informing us of special property conditions

Owen’s Landscaping is not liable for:

  • Pre-existing property damage
  • Hidden obstacles (e.g., unmarked pipes, wiring, irrigation issues)

9. PLANT & MATERIAL WARRANTY

  • 14-day plant replacement policy (with proper care)
  • Does not cover damage from weather, pests, animals, or neglect

10. PHOTOS & MARKETING

We may take photos of work performed for:

  • Documentation
  • Quality control
  • Marketing purposes

Customers may opt out in writing.

11. CUSTOMER RESPONSIBILITIES

By using our services, you agree to:

  • Provide accurate information
  • Communicate concerns promptly
  • Treat staff respectfully

We reserve the right to refuse or discontinue service in cases of unsafe conditions or inappropriate behavior.

12. THIRD-PARTY SERVICES

We may use third-party tools (e.g., payment processors, scheduling platforms).

We are not responsible for issues caused by third-party systems outside our control.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Owen’s Landscaping is not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid for the service

14. DISPUTES

Customers agree to contact us first to resolve any issues.

Chargebacks filed without prior communication may result in account suspension.

15. CHANGES TO TERMS

We may update these Terms at any time. Updated versions will be posted on our website with a revised date.
