Owen’s Landscaping Terms of Service

Welcome to Owen’s Landscaping! These Terms of Service ("Terms") govern your use of all landscaping, lawn care, design, and maintenance services provided by Owen’s Landscaping (“we,” “our,” or “us”). By booking or receiving any service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Service Agreement and Scope
When you schedule a service with Owen’s Landscaping, you enter into a service agreement for professional landscaping services. This may include, but is not limited to:

Lawn mowing, trimming, and edging

Landscape design and installation

Mulching and bed maintenance
-
Seasonal clean-ups
-
Tree and shrub care
-
Irrigation adjustments

Hardscape construction
Each service agreement will be outlined in your written quote or service confirmation. Any changes or additions to the original scope of work must be documented and approved in writing.
2. Booking, Deposits & Photos
To secure a scheduled service, the following conditions must be met:

A non-refundable deposit equal to 50% of your estimated invoice is required at the time of booking.

Deposits are applied toward your total balance due.

A clear, up-to-date photo of your yard or service area must be submitted prior to your booking. This helps us evaluate your property accurately and plan accordingly.

No work will be scheduled until the deposit and photo have been received and confirmed.
3. Scheduling and Arrival Times

We strive to arrive at your location within the time window provided at booking.

Due to the nature of outdoor work, delays can occur due to weather, traffic, or other project overruns. You will be notified of any major delays.

We reserve the right to adjust schedules based on weather conditions or job site safety.
4. Cancellation, Rescheduling & No-Show Policy

Cancellations made more than 48 hours in advance will not incur additional charges beyond the deposit.

Cancellations made within 48 hours of service may be subject to a cancellation fee up to 100% of the remaining balance.

A one-time rescheduling is permitted without charge if requested at least 24 hours in advance.

If we arrive at your property and are unable to complete work due to locked gates, blocked access, or unsafe conditions, a $50 trip fee may apply.
5. Payment Terms

The remaining balance of your invoice is due immediately after your service is completed, unless otherwise agreed in writing.

We accept payments via credit/debit cards, cash, checks, and secure online payment links.

Past-due accounts may be subject to late fees and may be sent to collections after 30 days of non-payment.

Any returned checks will incur a $35 returned item fee.
6. Customer Responsibilities
To help us deliver timely and quality service, customers agree to:

Provide clear and safe access to the service area.

Remove personal items, vehicles, or obstacles from the work zone.

Secure all pets and ensure children remain indoors during service.

Notify us of any underground systems (e.g., irrigation, lighting, wiring) or known hazards before service begins.
Failure to meet these responsibilities may delay service and could result in additional fees.
7. Weather Delays and Safety

Landscaping work is highly dependent on weather conditions. We reserve the right to reschedule or pause service during heavy rain, lightning, extreme heat, or other hazardous conditions.

We will contact you promptly in the event of any weather-related changes to your appointment.
8. Satisfaction Guarantee
Your satisfaction is our priority. If you are unhappy with the results of any service, please contact us within 48 hours of completion. We will review your concern and, if warranted, schedule a follow-up service or apply a credit to your account.
We do not guarantee results for conditions beyond our control such as soil health, pest infestations, or customer neglect.
9. Property Damage and Liability

Owen’s Landscaping is fully licensed and insured.

We take all reasonable precautions to protect your property. However, we are not liable for damage caused by:

Undisclosed underground systems or materials

Pre-existing damage

Improper installation by a third party

Any claims of property damage must be reported within 72 hours of the completed service.
10. Photos, Promotions & Reviews

From time to time, we may take before and after photos of your property for documentation or marketing purposes. These photos may appear on our website or social media unless you request otherwise in writing.

We may offer promotional discounts, referral bonuses, or seasonal offers. These promotions are subject to change at any time and may not be combined with other offers.
11. Privacy Policy
We respect your privacy. Any personal information you provide (such as name, address, phone number, or payment information) is kept confidential and used only to provide our services. For more details, see our Privacy Policy.
12. Modifications to Services and Terms
We may update or modify these Terms of Service at any time. Updated terms will be posted on our website and are effective as of the date posted. Your continued use of our services after changes are made signifies your agreement to the new terms.
13. Dispute Resolution
Any disputes or claims related to our services will be addressed through direct communication first. If a resolution cannot be reached, both parties agree to pursue resolution through mediation or arbitration before taking legal action.
