Welcome to Owen's Landscaping (\"Owen's Landscaping,\" \"we,\" \"our,\" or \"us\"). These Terms & Conditions (\"Terms\") govern your use of our website and landscaping services.

By accessing our website, requesting an estimate, booking a service, or purchasing any service from Owen's Landscaping, you agree to these Terms.

1. Services

Owen's Landscaping provides residential and commercial landscaping and property maintenance services, which may include:

Lawn mowing and maintenance
Landscape edging
Seasonal cleanups
Mulch installation
Snow removal
Property maintenance
Landscape lighting
Irrigation and drainage services
Other landscaping services we may offer

Service availability may vary by location, weather conditions, scheduling, and season.

2. Estimates

All estimates are provided based on the information available at the time of inspection or consultation.

Final pricing may change if:

Property conditions differ from those originally disclosed.
Additional work is requested.
Hidden obstacles or site conditions are discovered.
The scope of work changes.

Any significant changes will be discussed with you before additional work is performed whenever reasonably possible.

3. Booking and Deposits

To reserve most scheduled services, a non-refundable deposit equal to 50% of the estimated service total is required.

Your appointment is not confirmed until:

The required deposit has been received (when applicable).
We have confirmed your appointment.

The deposit will be applied toward your final invoice.

4. Customer Responsibilities

Customers agree to:

Provide accurate contact and property information.
Ensure reasonable access to the service area.
Secure pets before our arrival.
Remove vehicles, toys, hoses, decorations, and other obstacles from work areas.
Inform us of underground utilities, irrigation systems, invisible fencing, or other hidden hazards.

Owen's Landscaping is not responsible for delays or additional charges resulting from inaccessible work areas or undisclosed hazards.

5. Payment Terms

Unless otherwise agreed in writing:

Payment is due immediately upon completion of service.
Accepted payment methods include approved electronic payment methods shown during checkout or invoicing.
Deposits are credited toward the final balance.

Failure to pay may result in:

Late payment reminders.
Suspension of future services.
Cancellation of upcoming appointments.
Collection efforts as permitted by law.

6. Cancellations and Rescheduling

Customers should provide at least 24 hours' notice to cancel or reschedule an appointment whenever possible.

Deposits are non-refundable except where required by law or if Owen's Landscaping cancels the service and is unable to reschedule.

We reserve the right to reschedule services due to:

Weather
Equipment failure
Employee illness
Safety concerns
Other circumstances beyond our reasonable control

7. Weather Delays

Many landscaping services depend on safe weather conditions.

If weather prevents us from safely completing your service, we will reschedule your appointment at the next available opportunity.

8. Property Conditions

Customers are responsible for informing us of:

Sprinkler systems
Invisible pet fences
Buried utilities
Landscape lighting wiring
Septic systems
Any known hazards

We are not responsible for damage resulting from undisclosed underground installations or unsafe property conditions.

9. Satisfaction

We strive to provide high-quality workmanship.

If you believe there is an issue with completed work, please notify us within 48 hours of service completion. We will review the concern and, when appropriate, work with you to determine a reasonable resolution.

10. Photos

We may take photographs of your property before, during, and after service to:

Document work performed
Maintain service records
Resolve service questions
Improve quality control

With your permission, photographs may also be used for marketing purposes.

11. Website Use

You agree not to:

Use the website for unlawful purposes.
Attempt unauthorized access to our systems.
Interfere with website functionality.
Submit false or misleading information.
Copy or reproduce website content without permission.

12. Intellectual Property

All content on our website, including text, logos, graphics, photographs, designs, and branding, is the property of Owen's Landscaping unless otherwise noted.

No content may be copied, reproduced, or distributed without prior written permission.

13. Limitation of Liability

To the fullest extent permitted by law, Owen's Landscaping shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services.

Our total liability for any claim related to a service shall not exceed the amount paid by the customer for that specific service.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

14. Indemnification

You agree to indemnify and hold harmless Owen's Landscaping, its owners, employees, and contractors from claims, damages, or expenses arising from:

Your violation of these Terms.
Inaccurate information you provide.
Unsafe conditions at your property.

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law principles.

Any legal disputes shall be brought in a court of competent jurisdiction located within the State of New Jersey, unless otherwise required by applicable law.
